Disney Claims Guest Negligence in Magic Kingdom Trolley Track Trip-and-Fall Lawsuit, Demands Jury Trial

Disney has filed a response to the lawsuit filed against them when a woman tripped and fell over the Magic Kingdom trolley tracks in October 2025. They claim she is negligent and owed a duty to use reasonable care for her own safety.

Disney’s Response

The lawsuit was filed by Rhonda Smith of Frankfort, Kentucky against Walt Disney Parks and Resorts. Filed on December 22, she claims that the trolley tracks did not adequately have marked steel rails and flangeways near a castle attraction. It caused her to trip and fall, resulting in permanent injuries and substantial medical expenses.

She claims that the area lacked adequate warnings, guardrails, cones, stanchions, or other measures necessary to protect guests from tripping hazards associated with the embedded track during nighttime crowd conditions and parade operations.

Disney has since responded to the lawsuit, and they defend that Smith was negligent and should have used reasonable care for her own safety. In addition, they state she breached her duty by failing to pay adequate attention to her surroundings, failing to observe or appreciate the condition(s), assuming the risk of injury, and/or otherwise failing to take precautions to avoid the incident.

They demand a trial by jury.
