A new class action lawsuit filed against Disney claims ESPN is using trackers that violate California privacy law.

Saleha Abdullah filed the lawsuit in California federal court on December 26, alleging ESPN.com’s use of tracking technology to collect user data without consent violates California’s Invasion of Privacy Act (CIPA).
The collected data includes information about the user’s browser, device, screen resolution, operating system, and location. The data is then sent to third-party companies to create targeted ads.
CIPA was enacted in 1967 to prevent “eavesdropping upon private communications” through wiretapping, recording, and other methods. It prohibits the use or installation of pen registers or tap and trace devices without consent.
Abdullah is represented by Reuben D. Nathan of Nathan & Associates APC and Ross Cornell of the Law Offices of Ross Cornell APC. They are seeking certification of the class action, damages, fees, costs, and a jury trial.
